Terms and Conditions of Online Sale
Terms of Sale and Information in accordance with GDPR EU 2016/679 (Privacy Code):
1. OBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION
On-line" sales contract means the distance contract, i.e. the legal transaction having as its object movable goods and/or services stipulated between a supplier, Luce Più di Cerbai Alessandro & C. S.A.S with registered office in Via S.Martino, 6 - 50063 Figline Valdarno (FLORENCE) Tuscany - Italy, and a consumer customer within a distance selling system organised by the supplier who, for this contract, uses the distance communication technology called "internet". All contracts, therefore, will be concluded directly through access by the consumer customer to this website, where, following the indicated procedures, he/she will conclude the contract for the purchase of the goods. Final consumer means the natural person who purchases goods and services for purposes not directly related to his or her professional activity. Below are the terms and conditions of sale, which shall remain effective until changed by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the website and will refer to sales made from that moment onwards.
2. SALE PRICES AND PURCHASING METHODS
All sales prices of the products displayed and indicated on the website, for which they constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code, are inclusive of VAT and all other taxes (unless otherwise indicated). All product prices are valid exclusively within the Italian territory. The cost of transport is free of charge (unless otherwise indicated); in the event of delivery abroad, any additional costs due to taxes or duties provided for by the regulations in force in the country of destination shall be borne by the consumer. The purchase contract is finalised by means of the exact compilation and consent to the purchase manifested through the adhesion given "on line". The customer may pay for the goods ordered using only the payment methods indicated on-line at the time of purchase.
3. PERFORMANCE OF THE CONTRACT AND MODE OF DELIVERY
Luce Più di Cerbai Alessandro & C. S.A.S will provide to deliver the selected and ordered products to the customers, according to the modalities mentioned in the previous article, by means of trusted couriers and/or forwarding agents. In the event of the addressee's absence at the time of delivery, a notice will be left and the customer must personally contact the courier or forwarding agent as soon as possible in order to agree on the delivery method. Delivery times, which shall never exceed, in any case, those envisaged by art. 6 Legislative Decree 185/1999 (30 days from the date of the order), may vary from the same day of the order to a maximum of fifteen working days. The aforementioned delivery times refer to products in stock at the time of the order. Delivery shall be made by carriers at street level. However, no liability can be attributed to the supplier for delayed or non-delivery attributable to force majeure or fortuitous events.
4. PRODUCT AVAILABILITY AND SHIPPING
The customer may purchase the products indicated in the prepared electronic catalogue in the necessary quantities. Should an order exceed the quantity available in the warehouse, the computer system shall nevertheless accept the purchase and the customer shall be notified of the estimated time required for procurement. The delivery of products purchased in the online catalogue may take place at addresses in Italy and abroad. In the event of particular logistical difficulties in transport (quantities and/or means employed), any surcharge on transport will be communicated. In case of acceptance of the order, Luce Più di Cerbai Alessandro & C. S.A.S will provide to deliver what requested by express courier to the address indicated on the order form. The normal delivery times, for the Italian territory, foresee a variable delivery of 3/8 working days from the moment the order is sent (weekends and holidays are not to be considered in the calculation of the delivery times). However, those who live on islands, in a peripheral area on Italian territory, and abroad, should consider the need for additional days as normal. In any case, the times indicated as delivery terms cannot be considered binding for Luce Più di Cerbai Alessandro & C.. S.A.S.
5. LIABILITY
Luce Più di Cerbai Alessandro & C. S.A.S. does not take any responsibility for inefficiencies due to force majeure such as accidents, explosions, fires, strikes and/or lock-outs, thefts, earthquakes, floods and other similar events that could prevent, totally or partially, to execute the contract in the agreed time. Luce Più di Cerbai Alessandro & C. S.A.S will not be responsible towards any party for damages, losses and costs suffered as a consequence of the non-execution of the contract for the above-mentioned causes, the consumer having the right only to the restitution of the price paid. Likewise, it shall not be liable for any fraudulent and illicit use that may be made by third parties, of credit cards, cheques and other means of payment, when paying for the products purchased.
6. GUARANTEES AND METHODS OF ASSISTANCE
Luce Più di Cerbai Alessandro & C. S.A.S markets high quality products and all products are covered by the original Italian manufacturer's warranty (minimum validity 24 months, pursuant to DL 24/02). Therefore keep the sales invoice or receipt enclosed with the product. The exact warranty terms are illustrated in the document enclosed inside the package. For articles not directly produced by Luce Più di Cerbai Alessandro & C. S.A.S, generally this service is directly provided by the manufacturers of the goods sold, but if the customer prefers, he can choose to be assisted by Luce Più di Cerbai Alessandro & C. S.A.S by any means, in the phases of return and management of the return under warranty. For this purpose, and in order to allow the staff to correctly fulfil the task, the customer will have to ask for the product return number by calling the number +39 055 958371. Any transport costs shall be borne by the customer. In any case, the reference regulations and the methods of application of the guarantee are those indicated and highlighted by the manufacturer in its certificate always attached to the product. The information contained in the product sheets are provided by the manufacturer. For articles not directly produced by Luce Più di Cerbai Alessandro & C. S.A.S, the same declines all responsibility in case of inaccuracies in the product specifications or documentation. The main characteristics are not binding and may be changed by the manufacturer without notice. We kindly ask you to contact us if you verify any deviations from the actual characteristics of the product so that we can intervene promptly.
7. OBLIGATIONS OF THE PURCHASER
The consumer undertakes and is obliged, once the "online" purchase procedure has been completed, to print out and keep these general conditions, which he/she will, moreover, have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased, and this in order to fully satisfy the condition set out in articles 3 and 4 of Legislative Decree no. 185/1999. It is strictly forbidden for the purchaser to enter false and/or invented and/or fictitious data in the registration procedure required to activate the process for the execution of this contract and the relative further communications; the personal data and e-mail address must be exclusively the purchaser's own real personal data and not those of third parties, or fictitious data. It is expressly forbidden to make double registrations corresponding to a single person or to insert data of third persons. Luce Più di Cerbai Alessandro & C. S.A.S reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.
8. RIGHT OF WITHDRAWAL AND COMPLAINTS
Consumers who, for any reason whatsoever, are not satisfied with the purchase they have made, have the right to withdraw from the contract entered into, without penalty and without specifying the reason, within a period of 10 working days from the day of receipt of the goods. The withdrawal must be manifested by sending within the aforementioned term of 10 days a registered letter with acknowledgement of receipt to the following address:

A telegram or fax may be sent within the same term, to be followed within 48 hours by the above-mentioned registered letter with acknowledgement of receipt confirming the withdrawal. The consumer may not exercise this right of withdrawal for products made to measure or clearly customised or which, due to their nature, cannot be returned or are liable to deteriorate or alter rapidly. Within the aforementioned period of 10 days, all the goods purchased must be returned to the sender-supplier intact and in their original packaging and any manuals, without any shortcomings. The return costs shall be borne by the customer. Once the goods have been received Luce Più di Cerbai Alessandro & C. S.A.S will provide for the forwarding of the whole amount paid by the consumer within the term of thirty days, with bank value date in any case not exceeding the fifteenth working day from the date of receipt of the withdrawal communication. It shall be the consumer's responsibility to promptly provide the bank details on which to obtain the transfer (IBAN code of the invoice holder).
9. CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE
Luce Più di Cerbai Alessandro & C. S.A.S has the faculty to terminate the stipulated contract by giving simple communication to the customer with adequate and justified motivations; in this case the customer will have the right only to the restitution of the eventual sum already assumed and paid.
10. PROVISION AND PROCESSING OF PERSONAL DATA
Personal data are collected for the purpose of registering the customer and activating the procedures for the execution of this contract and the relative necessary communications; such data are processed electronically in compliance with the laws in force and may only be produced at the request of the judicial authorities or other authorities authorised by law. Personal data will be used to carry out the activities necessary for the execution of the contract stipulated and to issue regular sales invoices. The interested party has the rights under the GDPR EU 2016/679 (Privacy Code), namely: to request confirmation of the existence of their personal data; to know their origin, logic and purpose of their processing; to obtain their updating, rectification and integration; to request their cancellation, transformation into anonymous form or blocking in the event of unlawful processing. 11. JURISDICTION AND COMPETENT COURT
Any dispute relating to the application, execution, interpretation and breach of purchase contracts stipulated "on line" through this site is subject to Italian jurisdiction; these general conditions refer, for all that is not expressly provided for herein, to the combined provisions of Legislative Decree No. 50 of 15.1.1992 and Legislative Decree No. 185 of 22.5.1999. For any dispute between the parties in connection with this contract, the Court of residence of the end consumer shall have jurisdiction. For all others the Court of Florence.
